How Bail Works
When someone is arrested, a judge sets a bail amount — a financial guarantee that the defendant will return for all scheduled court appearances. Bail allows the defendant to be released from custody while their case is pending.
Most people cannot afford to pay the full bail amount out of pocket. That's where a licensed bail bond agent comes in. Instead of paying the full amount, you pay a non-refundable premium of 10% of the total bail to the bail bond agency. The agency then posts a surety bond with the court for the full bail amount, securing the defendant's release.
For example, if bail is set at $50,000, you would pay a $5,000 premium to the bail bond agent. The agent guarantees the full $50,000 to the court on your behalf.
Once the case concludes — whether through dismissal, acquittal, or sentencing — the bond is exonerated (released). However, the 10% premium is the bail agent's fee for the service and is not returned.

Indemnitor / Co-Signer Responsibilities
As the person signing for the defendant's release, you take on the following obligations:
Court Appearance Guarantee
You are responsible for ensuring the defendant appears at every scheduled court date. Failure to do so can result in serious financial consequences.
Financial Liability for Failure to Appear
If the defendant fails to appear in court (FTA), you as the indemnitor become financially liable for the full bail amount — not just the premium.
Non-Refundable Premium
The 10% premium paid to the bail bond agency is non-refundable once bail has been posted, regardless of the outcome of the case.
Collateral May Be Required
For larger bond amounts, collateral such as property, vehicles, or other assets may be required to secure the bond.
